Who we are
These terms cover the websites of Modern Art Gallery and MAG Contemporary, New Delhi. By using the site or enquiring about a work you agree to them. If anything here is unclear, write to sales@modernartgallery.co.in and we will explain.
Enquiries are not orders
The website shows works for information and enquiry. Adding a work to your enquiry list or messaging us on WhatsApp does not buy it. A sale happens only when the gallery confirms it in writing and issues an invoice. Until then a work may be sold to someone else, withdrawn or re-priced.
Prices and taxes
Prices are in Indian rupees. Unless we say otherwise they do not include GST, packing, shipping, insurance or any customs duty on international deliveries, which we will quote before you confirm. If a price on the site is wrong, we will tell you and you may cancel before paying.
Payment and delivery
Full payment is due within 7 working days of the invoice, by bank transfer or another method we agree. A work leaves the gallery only after payment has cleared. Delivery is by a professional art handler, insured in transit; you may also collect from the gallery.
Authenticity and condition
Every work is sold with a certificate of authenticity signed by the gallery and, where possible, the artist. Ask us for a condition report, extra photographs or a viewing before you buy. Colour, texture and scale on a screen are approximations of the real work.
Returns
Because each work is unique, sales are final once a work has been delivered or collected. If a work arrives damaged, tell us within 48 hours with photographs and we will resolve it with the insurer. Returns for other reasons are at the gallery's discretion.
Copyright and images
Copyright in every artwork stays with the artist. Buying a work does not include the right to reproduce it. Photographs, texts and online viewing rooms on this site belong to the gallery and the artists; you may share them for personal, non-commercial use with credit, and for anything else please ask first.
The website
We try to keep the site accurate and available but cannot promise it will be error-free at all times. Our liability for anything connected with the site is limited to the amount you have paid us for a work. These terms are governed by Indian law; the courts at New Delhi have exclusive jurisdiction.
Changes
We may update these terms from time to time. The date at the top tells you when they last changed; the version on the site when you enquire is the one that applies.
